While the “Public Charge Rule” implemented by the previous administration still exists, there have been a number of court rulings invalidating it, and the government will not appeal those rulings. For all practical purposes, it will not
apply. There is still, and always has been, a public charge test that applies to SOME green card applicants. Receiving ongoing cash assistance would be a problem for those immigrants. For more information on who it applies to or what benefits count, see
our publication “Public Charge: What You Need to Know,” at
https://www.washingtonlawhelp.org/resource/public-charge-when-is-it-safe-for-immigrants-to-get-benefits.
It IS safe to use food assistance. Medical assistance (other than long-term care in a facility) is also safe, so immigrants should get the health care they need during the pandemic.

Subject: Homeless Coalition - COVID-19 supplemental food for children of non-citizens
Good morning everyone,
This is more like a general legal advice, any information would be helpful. We have a few families that are in the process to become legal residents. Their children are eligible for supplemental food assistance that was approved by the
congress due to the impacts of COVID-19, but parents are scared to apply because they don’t want this to hurt their immigration process. I know with the previous administration this was a restriction, but I don’t know if is still effective.
Thank you in advance for any guidance.
