We have CM Thoms agreement to try to make this ordinance something positive and progressive (my word - he didn't say that) - I'd like to spend some time this afternoon on the "where as" section at the beginning of the ordinance - then if we have time, get into
the code. We'll use Tristia's comments as the place to begin. Hopefully this version doesn't dance or do anything it shouldn't.
This section is important because it sets the context for the code change and sections like this are used by courts to interpret intent.
CM Thoms has actually given us a fair amount of language that sounds like us. I'm hoping we can draft something agreeable.
The other things we need to talk about is how we handle enforcement - should there be any? should it be by law enforcement? if not them, who? How?
Assuming that some folks will simply not accept what appears to be an acceptable option but set their tent on public property, what should be the response. Assume there is sufficient shelter but they refuse it. Assume they aren't doing anything illegal. Just
camping on public property. What should happen?
